Appointing An Independent Lawyer
One of the most important steps is to appoint an independent Cyprus lawyer before committing to a purchase.
Your lawyer should act solely in your interests and carry out the necessary legal checks on the property, the seller and the proposed transaction. They will also explain the contract of sale, advise you on the applicable taxes and fees, and guide you through the process of transferring ownership.

The Property Buying Process
Although every transaction is different, the purchase of a property in Cyprus will generally involve agreeing the terms of sale, appointing a lawyer, carrying out legal due diligence, signing the contract and completing the transfer of ownership.
Your lawyer should establish that the seller has the legal right to sell the property and investigate any mortgages, charges, restrictions or other encumbrances registered against it.
They should also check the property’s title deed position, planning and building permits, and any relevant approvals. Where separate title deeds have not yet been issued, your lawyer should explain the implications and the protections available to you.
The Contract Of Sale
Once the necessary checks have been completed, your lawyer will prepare or review the contract of sale.
The contract should clearly set out the agreed purchase price, payment schedule, property description, completion arrangements and the obligations of both buyer and seller. Any fixtures, fittings, furniture or other items included in the sale should also be properly recorded.
Your lawyer will advise on the appropriate arrangements for signing and depositing the contract with the Department of Lands and Surveys, including the protections available under Cyprus’s specific performance legislation.
It is important not to sign documents or transfer substantial funds without understanding the terms and receiving appropriate legal advice.
Title Deeds And Legal Checks
Title deeds are an important consideration when purchasing property in Cyprus.
Some resale properties have separate title deeds available for immediate transfer, while other properties, particularly newer developments, may have title deeds that are still in the process of being issued.
The absence of a separate title deed does not automatically mean that a property cannot be purchased, but it does make independent legal due diligence particularly important.
Your lawyer should explain the exact position, check the relevant permits and approvals, investigate any encumbrances and advise you on the contractual safeguards required for your particular purchase.
Costs Of Buying Property In Cyprus
In addition to the purchase price, buyers should budget for the applicable taxes, legal fees and other expenses associated with the transaction.
The amount payable will depend on the property, whether VAT applies, the ownership structure and your individual circumstances. Your lawyer should provide a written estimate of the anticipated costs before you commit to the purchase.
Stamp Duty
Cyprus abolished stamp duty for documents executed on or after 1 January 2026. Contracts signed before that date may still be subject to the previous rules, so your lawyer should confirm the position if you are dealing with an older agreement.
Property Transfer Fees
Transfer fees are generally payable when ownership of the property is transferred into the purchaser’s name at the Land Registry.
Where VAT is charged on the same property transaction, transfer fees are generally not payable. For transactions that are not subject to VAT, a 50% reduction normally applies to the calculated transfer fees, subject to the relevant legal provisions and exceptions.
The standard transfer fee bands before the applicable reduction are:

The calculation may differ depending on the number of purchasers and the circumstances of the transaction. Your lawyer should confirm the actual amount payable rather than relying on a general estimate.
VAT On Property
VAT may apply to certain property purchases, particularly new-build properties and first sales.
The standard VAT rate is 19%, although a reduced rate may be available for qualifying purchases of a primary and permanent residence, subject to the applicable conditions, limits and approval requirements.
The reduced VAT rules have changed in recent years and include transitional provisions for certain properties. Your lawyer and tax adviser should confirm whether you qualify and what rate applies to the particular property you intend to purchase.
Other Expenses
You should also allow for legal fees, Land Registry charges, survey or valuation costs where appropriate, mortgage expenses if finance is required, insurance, currency exchange costs and any moving or furnishing expenses.
For resort properties and apartments, it is also important to understand communal charges, maintenance contributions and any applicable membership or facility fees before purchasing.
Can Non-EU Citizens Buy Property In Cyprus?
Yes, non-EU citizens can purchase property in Cyprus, but the acquisition of immovable property is subject to specific rules and, in many cases, permission from the relevant District Administration.
The requirements depend on the purchaser, the type of property and the intended acquisition. British citizens are now treated as non-EU nationals for these purposes.
Your lawyer should advise you on the applicable restrictions and, where required, prepare and submit the necessary application for permission to acquire the property.
Does Buying Property Give You Residency?
Buying a property in Cyprus does not automatically grant the purchaser the right to live permanently in the country.
Residency requirements depend on nationality, personal circumstances and the immigration route under which an application is made.
Cyprus has an expedited permanent residence scheme for qualifying non-EU investors. Under the current published criteria, eligible applicants may qualify through an investment of at least €300,000, but the scheme has specific requirements relating to the type of investment, source of funds, income and supporting documentation.
For example, the qualifying residential property route generally requires a first sale from a development company, and applicants must satisfy the applicable secure annual income requirements. A resale home of the same value does not automatically qualify under that residential investment category.
Anyone considering purchasing property for residency purposes should obtain specialist immigration advice before making a financial commitment.
Buying Property As An Investment
If you intend to rent your property, your lawyer and tax adviser should explain the legal and tax implications of doing so.
Short-term holiday rentals may be subject to registration and other regulatory requirements, while rental income can create tax obligations in Cyprus and potentially in your country of tax residence.
It is important to assess the actual costs and realistic rental potential of a property rather than relying solely on projected gross income.
